These Terms & Conditions (“Terms”) govern your download, installation, access to, and use of the mobile application Birdigo (“Application”) operated by Softcom (“us”, “we”, or “our”).

By downloading or using the Application, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the Application.

1. Description of Service

The Application is a mobile-based scorecard, shot tracking, and GPS coordinate utility designed for golf courses. Features include logging scores, club tracking, and rendering distances on golf greens.

2. GPS and Coordinates Disclaimer

The Application uses your device’s built-in GPS/location services to estimate distances and coordinates.

  • Accuracy: We do not guarantee the absolute accuracy, completeness, or reliability of any coordinates, distance yardages, or maps provided.
  • Liability: GPS accuracy depends on satellite coverage, device hardware, and local weather. We are not responsible for any damage, loss, injury, or frustration resulting from incorrect measurements or coordinates during play.

3. Account and Registration

To use certain features of the Application, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your login credentials.
  • Promptly notify us if you discover any security breaches related to the Application.

4. Intellectually Property Rights

The Application and its original content, features, layout, and functionality are and will remain the exclusive property of Softcom and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Application or included software.

5. Limitation of Liability

In no event shall Softcom, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Application.
  • Any errors or inaccuracies in the course coordinates or mapping features.

6. Termination

We may terminate or suspend your account and bar access to the Application immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of your country, without regard to its conflict of law provisions.
